Scope
These terms apply to the use of this website and to the software development services offered on it: websites and web applications, mobile apps, databases, APIs, scripts, integrations and automation, and changes to existing software. A signed quote can add specific terms; if they differ, the quote prevails.
Using this website
You may browse the site for personal or business information. You agree not to disrupt its operation, attempt to access it without authorization or copy its content for commercial use without permission. The site may be interrupted for maintenance without notice.
Intellectual property
Texts, illustrations, graphics and code of this site belong to Owen Alexander Amaya Hernandez unless stated otherwise. Any reproduction without written permission is prohibited. Third-party names and trademarks belong to their owners.
Quotes and orders
Prices shown on the site are starting prices given for information. Every project gets a written quote describing scope, deliverables, timeline and price. The quote is valid for 30 days. An order is confirmed when you sign the quote and, where stated, pay the deposit.
Prices and payment
Prices are in euros. Unless the quote says otherwise, 30% is paid when the order is confirmed, and the balance on delivery. Invoices are payable within 30 days. Late payments by business clients bear interest at three times the French legal interest rate plus a fixed recovery fee of €40 (French Commercial Code, art. L441-10).
Delivery and acceptance
Timelines in the quote depend on you providing content, access and feedback on time. You have 10 working days after delivery to report defects; without a report, the work is accepted. Changes outside the agreed scope are quoted separately.
Ownership of the work
Once the work is fully paid, you receive the property rights in the code and assets made specifically for you, for all uses and the full legal duration, unless the quote says otherwise. Open-source libraries keep their own licences. General tools and know-how that I developed before or outside the project stay mine, with a free licence for you to use them in the delivered work.
Your responsibilities
You confirm that you have the rights to the content, data and existing software you provide, including the right to have third-party software modified. You remain responsible for backing up your data before work on live systems, unless backups are included in the quote.
Warranty and liability
I fix, free of charge, defects reported within 3 months of delivery that come from my work and from the agreed scope. I am responsible for direct damage I cause, limited for business clients to the amount paid for the project concerned. I am not liable for indirect losses, third-party services, or changes made by others after delivery. Nothing here limits the legal guarantees of consumers.
Consumers
If you are a consumer and sign a contract at a distance, you have a 14-day right of withdrawal from the signature, unless you ask for work to start earlier and acknowledge losing that right once the work is complete. In case of a dispute, you may use a consumer mediator free of charge; the mediator's details are given in the quote.
Confidentiality
Information you share about your business, code and data is kept confidential and used only for the project, during the project and for 5 years after it ends.

How personal data is handled is described in the Privacy Policy and the Cookies Policy.
Applicable law and disputes
These terms are governed by French law. The parties will first try to settle any dispute amicably. Failing that, disputes with business clients go to the competent courts of Paris; consumers may choose the courts provided by law.
